III. TOWN PLANNER’S REPORT
Master Plan Committee
Town Planner Noreen O’Toole told the Board that she and Administrative Assistant Barbara Ferguson had met with Carol Thomas of Thomas Planning Services in Boston. Also in attendance was a new consultant Samuel Seidel who is working on the municipal services component of the Master Plan and expects to have it completed in October. Old Colony Planning Services is doing the circulation component, she said, which should take about a month. She distributed to Board members copies of the town’s new Community Development Plan which was done by Thomas Planning Services and the Old Colony Planning Council through a $30,000 grant from the Massachusetts Department of Housing and Community Development and the Executive Office of Transportation and
Construction, under Executive Order 418.
Hanson Trails Committee
Ms. O’Toole said that there had been no activity related to the Hanson Trails Committee.
Zoning Bylaw Committee
Ms. O’Toole said that there had been no recent meetings of the Zoning Bylaw Committee but that she would be submitting two articles on the committee’s behalf to correct the wording in two sections of the Zoning Bylaw.
Old Colony Planning Council Joint Transportation Committee
Ms. O’Toole said that the next meeting of the Old Colony Planning Council Joint Transportation Committee would be held in Brockton on September 9, 2004 at noon. She said that she had been in communication with the Hanson and East Bridgewater Highway Surveyors concerning the proposed improvements to the intersection of Routes 14 and 27. Everything has to be submitted to the state within the next two weeks, she said, or the $2.3 million project will go to the bottom of the list and some other community’s project will get the money.
Other Matters
Ms. O’Toole asked Board members if they wanted to submit an article for the October 4, 2004 special town meeting seeking an appropriation to update the town’s subdivision rules and regulations.

IV. APPOINTMENTS
Form A/ANR
Nina Drive
The Board met with Al Vautrinot of Vautrinot Land Surveying, Inc. of Plympton, Donald Ellis of Hanson, and Attorney Gene J. Guimond of Braintree to review a Plan of Land, dated August 9, 2004, prepared for Mr. Ellis. The plan creates four lots off Nina Drive and one off Elm Street. Two of lots off Nina Drive have 175 feet of frontage and two are retreat lots with 40 feet of frontage. Chairman Philip Lindquist said that he had a problem with creating more than one retreat lot in what was initially constructed as a subdivision, the 1,500 square foot access, drainage and utility easement strip in front of Lot 2 on Elm Street identified as Parcel A, and the failure to carry the 175 foot frontage back 100 feet on Lot 1 on Elm Street.
Virginia Costley, a resident of Nina Drive, said that there are existing drainage problems on the street and asked if there were any plans to handle the drainage associated with the proposed new homes. She also questioned the Parcel A easement. She noted that a home on Whitman Street had to be demolished to meet the town’s corner lot zoning requirements so a new subdivision could be built. Mr. Ellis said that he would not be changing any grades or creating any more water flow. Nina Drive residents Merleen Sammon, and Joseph and Carol Gillis also expressed concern with the potential for additional drainage problems. Mrs. Gillis said that when she bought her house she was told that there were strips of land that could not be sold and one of
them was the one Mr. Ellis was using for access to the proposed new lots on Nina Drive.
Board member said that they wanted some time to review the plan and the drainage calculations for the original subdivision. Mr. Vautrinot said that Nina Drive is now a public street and Mr. Ellis is not responsible for any drainage improvements. Attorney Guimond said that the area is no longer a subdivision and he distributed copies of related case law in support of his position that the Planning Board has no other option than to approve the Form A/ANR under the provisions of Massachusetts State Law, Chapter 41, Section 81L regardless of the concerns of the abutters.

V. NEW BUSINESS
Cranberry Estates
Construction Inspection Report, Land Planning, Inc.
Board members noted an August 13, 2004 Construction Inspection Report from Land Planning, Inc. relative to Cranberry Estates outlining the issues that need to be resolved before the subdivision is ready to go before Town Meeting for acceptance.
Memo from P.M.P. Associates
Drainage Issues at Hemlock Hills
Board members noted an August 11, 2004 memo from P.M.P. Associates of East Bridgewater relative to drainage issues at the Hemlock Hill subdivision which recommended an on-site meeting to include both the developer’s and the Board’s the engineering firms and the chairman of the Planning Board.
VI. OLD BUSINESS
Letters to 12 Developers
Expiration Date for Completion of Subdivisions
Board members took home for review the correspondence from developers in response to a certified mailing from the office indicating that the approved dates for completion of their subdivisions had expired.

Closing Date for October Special Town Meeting
Board members noted an August 13, 2004 memorandum from Executive Assistant Meredith Marini advising that the closing date for submitting articles for the October 4, 2004 special town meeting will be Tuesday, August 24, 2004 at 4 p.m.
